Victory for Daleside Nursing Home

Daleside Nursing Home forms part of an expanding group of Care Homes being run by Beech Jones Law’s client Kate Armstrong Shone. As with all Kate’s homes, it is being run to the highest standards. In addition to providing a good living environment for up to thirty-two older residents, Daleside provides a happy, safe and friendly working environment for all of its employees.

It therefore came as a huge shock to Kate when Daleside faced an Employment Tribunal Claim brought by a disaffected nurse. This former employee alleged that she had been the victim of racial abuse and had been constructively unfairly dismissed.

With the help, support and encouragement of Mr Paul Dumbleton and Mr Stephen Nettle of Beech Jones Law, Daleside was successful in defeating all of the claims brought against it, following a two day hearing before the Liverpool Employment Tribunal.

Following thorough preparation and robust cross-examination by Stephen Nettle, the Tribunal unanimously found that the claims brought against Daleside were unsubstantiated and that the former employee in question had simply not been racially abused as she had alleged. The Tribunal also found that Daleside had not received various grievance letters which the Claimant asserted had been sent to Kate.

Kate was overjoyed by the outcome, which fully vindicated her brave decision to contest the case, rather than settling the case for reasons of convenience.

She said: “I am very pleased to have successfully defeated this spurious legal action, which has caused myself, my family and the staff at Daleside a large amount of distress. I am particularly pleased with the outcome from the point of view of the highly experienced nurse who was wrongfully accused of being racially abusive towards the Claimant.

I could not have fought off this questionable claim without the tremendous amount of hard work invested into my case by Beech Jones Law and the excellent presentation of our position before the Tribunal by Stephen Nettle.”
